1. Acceptance of Terms

By using this service, you agree to these Terms of Service.

1a. Age Requirement

You must be at least 13 years old to use this service. If you are under 18, you may only use the service with the involvement and consent of a parent or legal guardian. By using NERRA, you confirm that you meet this age requirement.

2. Description of Service

NERRA is an AI-powered English language learning platform available as a web application (nerra.online) and mobile applications for iOS and Android. The service includes:

• CEFR-based English level assessment (reading, writing, listening, speaking)
• Lessons assigned by teachers with interactive exercises
• Vocabulary games (11 game types) for word practice
• AI-powered evaluation and feedback
• Progress tracking and learning statistics

3. AI Evaluation Disclaimer

All results are generated using artificial intelligence:

• The CEFR level provided is not an official certification
• Results are for informational purposes only
• Accuracy is not guaranteed
• Users agree that results cannot be disputed or used as formal proof of language proficiency

4. User Responsibilities

Users agree:

• To provide genuine responses during assessments
• Not to use automated tools, bots, or scripts to interact with the service
• Not to reverse-engineer, decompile, or extract source code from the application
• Not to share account credentials or allow others to use your account
• Not to scrape, copy, or redistribute assessment content
• Not to use the service for any unlawful purpose

4a. Teachers and Student Content

If you use NERRA as a teacher (creating lessons and connecting students), you additionally agree that:

• You are responsible for the lessons and content you create and for how you use your students' results.
• You will only invite or add a person as your student if you are entitled to do so. If a student is a minor, you confirm that the required parental or guardian consent has been obtained.
• You retain ownership of the original lessons you create. You grant NERRA a non-exclusive licence to host, display, and deliver that content to the students you assign it to, solely to operate the service.
• You will not upload content that infringes third-party rights, is unlawful, or is inappropriate for the students who will see it.

Students' answers and homework results are shared with their connected teacher as described in the Privacy Policy.

5. Data Usage

By using the service, you agree to the processing of your data, including:

• Written responses
• Voice recordings (for transcription and evaluation)

6. Limitation of Liability

We are not responsible for:

• Inaccuracies in AI-generated results
• Decisions made based on the results
• Any damages resulting from use of the service

7. Modifications

We may modify or discontinue the service at any time.

8. Termination

We may suspend access if these Terms are violated.

9. Subscriptions, Marketplace and Payments

Some paid features (Premium plans and the teacher lesson marketplace) may not be available yet. Where a paid feature is not active, no charge is made; when it launches it will be governed by the terms below.

NERRA offers both free and paid plans:

• Free plan: includes a limited number of assessments and basic features
• Premium plan: includes unlimited assessments, detailed AI feedback, and additional features

If you purchase a Premium subscription:

• Payment is charged at the beginning of each billing period
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can cancel your subscription at any time through your account settings or the payment provider
• Cancellation takes effect at the end of the current billing period — you retain access until then

Teacher lesson marketplace. When the marketplace is available, teachers may list lessons for other teachers to acquire. NERRA only facilitates these transactions; the listing teacher is responsible for their content and for having the rights to sell it. Applicable fees, payouts, and any marketplace-specific refund rules will be shown at the point of sale and are governed by these Terms.

10. Refund Policy

For purchases made through Apple App Store or Google Play Store, refunds are handled by the respective platform according to their refund policies. To request a refund, contact Apple Support or Google Play Support.

For purchases made through our website, payments are processed by our reseller and Merchant of Record, Paddle.com, which also handles refunds. Refund eligibility (including the paid expert review) is set out in our Refund Policy. To request a refund, email privacy@nerra.online with your order details.

11. Advertising

The mobile application contains third-party advertisements served by Google AdMob. By using the app, you agree to Google's advertising policies. You may opt out of personalized ads in your device settings. On iOS, you will be asked for consent via the App Tracking Transparency prompt before any ad-related tracking occurs.

12. Account Deletion

You may delete your account at any time through the app (Profile → Delete Account) or by emailing privacy@nerra.online. Account deletion is permanent and removes all your data. See our account deletion page for details.

13. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be resolved in the courts of Thailand.
